I. Introduction

We greatly value your business and strive to provide a transparent and equitable approach to handling returns and refunds. This policy delineates the terms and conditions governing returns and refunds for Creations acquired through our Platform. By participating in any transaction with Mironova Art, you implicitly agree to adhere to the provisions set forth in this Policy. It is imperative to carefully read this document to comprehend the procedures and conditions related to returns and refunds.

The following terms are applicable for any Products that You purchased with Us.

These Return and Refund Policy and any operating rules and policies posted on the Platform, including Mironova Art Terms and Conditions, Creator's Terms of Use, Dealer's Terms of Use, Dispute Resolution Procedure, Shipping Policy, Return and Conditions of Sale, Content Guidelines constitute the entire legally binding agreement and understanding between us and our users, governing your access to and use of Platform (“Agreement”).

II. Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Return and Refund Policy:

Mironova Art (referred to as either “Mironova Art”, “We”, “Us” or “Our”) refers to NobleArts OÜ, Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152.

Products refer to the items offered for sale on the Platform.

Order means a request by You to purchase Products from the Platform.

Platform refers to the Mironova Art online Platform, accessible from www.mironova.art

Service refers to the Services provided by Mironova Art through the Platform, including but not limited to all functions and features accessible through the Platform.

User (referred to as either “You”) refers to the individual or a legal entity accessing or using the Platform. When you visit the Platform, you become our user.

We divide the Users into categories so you can easily find details about the processing of your personal data.

  • Sellers – users, who sell goods on the Platform (Creators and Dealers), both individual and corporate entities.
  • Clients – users, who buy goods on the Platform.
  • Platform users – users, who visit and use our Platform.

By using the Platform you make these Terms valid and mutually binding for the parties, and you declare and warrant that:

  • you have read and understand the Agreement and hereby agree to be legally bound by and to comply with these Terms in full;
  • you have full legal capacity, which means you have reached the legal age and are not restricted otherwise (otherwise, you can use Platform exclusively with the involvement of a parent or guardian);
  • you are duly authorized to act on behalf of the legal entity you represent (if applicable);
  • according to your local jurisdiction, you are eligible to enter into this agreement and have no restriction to access or use the Platform;
  • you comply with these Agreement and all applicable laws and regulations.

III. Mironova Art's Role

Mironova Art functions solely as an intermediary between sellers registered on our Platform and Clients purchasing Items through it. We do not directly sell any of the Items listed on our Platform.

Mironova Art does not assume responsibility for Sellers' adherence to or deviation from laws governing the return and refund process. While we offer support and guidance to both Sellers and Clients regarding returns and refunds, we are not liable for ensuring compliance with international and national regulations concerning these processes. Additionally, while we strive to aid in resolving conflicts between parties, we cannot be held accountable if assistance is unsuccessful.

The requirements outlined in this Returns and Refund Policy serve as the minimum standards for Sellers on our Platform. Failure to adhere to these standards may result in the termination of the respective Seller’s account.

Conversely, this policy delineates the rights of Clients, granting them the option to return goods to the relevant seller and receive a full refund, contingent upon meeting the stipulated requirements outlined further in this policy.

IV. Return and Refund Eligibility

Mironova Art offers a straightforward return and refund process without the need for the client to provide an explanation. Clients are eligible for a full refund if the following conditions are met:

a. Artwork Condition: The Item/s must be returned to the relevant Seller in the same condition as when delivered to the client.

b. Original Packaging: The Item/s must be returned to the relevant Seller in the same packaging as when delivered to the client.

c. Return of Artwork: Clients are responsible for returning the Creation to the relevant Seller at their own expense, if not agreed otherwise with the Seller or Mironova Art.

V. Delivery Acceptance

Upon receipt of your Product, please undertake a thorough inspection. Should there be any visible damages or discrepancies in your order, you must refuse the parcel and initiate its return to the respective Seller while still at the post office. Otherwise, you must contact our customer support within 24 hours of receiving the Item. It is essential that you take photos and/or make videos of any damage inflicted on the ordered items as evidence. Mironova Art will pass this material proof on to the Seller, or directly to the insurance provider in cases where Mironova Gallery is the Seller. You must also retain the original packaging in the event of returns.

VI. Time Limit for Returns and Refunds

Clients must initiate their return and refund requests within 14 days from the date of receival of the ordered items. After this 14-day period, returns and refunds may not be processed. After notifying the Seller of their intention, Clients are granted an additional 14 days to initiate the return process for the product. The deadline for when Mironova Art can initiate a refund is 14 days from the day the order has been delivered to and picked up by the relevant Seller.

VII. Handling Return and Refund Requests

Mironova Art has designated email as the exclusive channel for processing return and refund requests. To initiate a return and refund request, follow these steps:

a. Email Notification: Clients are required to send an email to refund@mironova.art within the stipulated 14-day time frame to initiate the return and refund process. In your email, please provide your order number and reason for returning the ordered items, and we will guide you through the return process.

b. Artwork Return: Clients are responsible for returning the acquired Items to the relevant Seller at their own expense. We will provide instructions on how to safely and securely package the Creation/s for return.

c. Refund: Once the returned artwork is received and inspected to confirm its undamaged condition, we will process a full refund to your original payment method. Please allow up to 14 business days for the refund to be completed.

VIII. Returning Items

You are responsible for the cost and risk of returning the Items to the relevant Seller. You should send the Creations to the address specified by the relevant Seller or Mironova Art.

We cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Items by the Seller or proof of received return delivery.

The Seller and the Client shall coordinate and organize the return of the Products. Mironova Art is not involved in this process and will not be responsible for the result.

IX. Non-Refundable Items

Mironova Art strives to maintain clear policies regarding non-refundable items. The only non-refundable items are as follows:

a. Commissioned Items: Creations commissioned specifically for the client are non-refundable.

b. Client-Damaged Items: Creations that have been damaged by the client are non-refundable.

c. Health/Hygiene Exclusion Items: Creations which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

d. Perishable/Expired Items: Creations which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.

e. Inseparable Mixtures: Creations which are, after delivery, according to their nature, inseparably mixed with other items.

We reserve the right to refuse returns of any merchandise that does not meet the above return conditions at our sole discretion.

X. Shipping Fees and Taxes

Shipping fees are non-refundable. The client is responsible for any customs duties or taxes associated with international shipments, unless otherwise agreed between the Client and the respective Seller or Mironova Art. Mironova Art will collect VAT or its equivalent and/or any taxes if required by law. The Seller is responsible for covering return shipment costs and insurance.

XI. Force Majeure

Mironova Art acknowledges the existence of unforeseen circumstances that may disrupt the return and refund process. Force majeure events, including but not limited to war, civil unrest, government-imposed restrictions, natural disasters, and public health crises, may impact our ability to meet stated return and refund deadlines. Clients are kindly requested to exercise patience and understanding in such extraordinary circumstances.
