I. InterpretationThe words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural. For the purposes of this Return and Refund Policy: Mironova Art (referred to as either “Mironova Art”, “We”, “Us” or “Our”, “Platform”, or “the Platform” in this Agreement) refers to NobleArts OÜ, Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152. Products (referred to as either “Items”, “Creations”, or “Products”) refer to the Items offered for sale on the Platform. Order means a request by You to purchase Goods from Us. Platform refers to the Mironova Art online Platform, accessible from www.mironova.art Service refers to the Services provided by Mironova Art through the online Platform, including but not limited to all functions and features accessible through the Platform. Client (referred to as either “Client” or “You”) refers to the individual or a legal entity accessing or using the Platform. II. Authenticity and Originalitya. Creators and Dealers are required to upload only those Items for which they possess the right to sell. b. Avoid listing Items that infringe upon copyrights, intellectual property rights, or trademarks of others. c. Replicas or copies (prints) of existing artworks must be clearly labeled and described as such. Additionally, the seller must obtain approval from the original artist before duplicating the works in question. d. For vintage or historical Items, provide accurate information regarding their origin, age, and any restorations or modifications done over time. e. If selling limited editions or numbered series, it is essential to clearly specify the edition size and the respective Item's individual number. Additionally, provide a certificate of authenticity if applicable. f. Clearly disclose if the creation has been previously exhibited, mentioning any significant history or provenance. g. Clearly disclose if the Item has been previously sold, and if so, specify the number of times it has changed hands. h. Ensure that any collaborative or co-created Creations credit all contributing parties. i. When incorporating cultural or traditional elements into artworks or products, ensure respect for the origins and meanings associated with those elements. j. In case of using found objects or recycled materials, disclose their origin and provide information on the transformation process into the final artwork or product. III. Accurate and Descriptive Listingsa. Provide accurate and detailed descriptions for each listed Item, including dimensions, materials used, techniques applied, and any special features. b. Use clear and high-resolution images that accurately represent the artwork or product, showcasing its details and quality. Offer multiple angles or views of the Item to provide a comprehensive understanding of its appearance and features. c. Avoid using misleading or inaccurate information, including false claims about the Item's history, significance, or creator. d. Clearly specify the Item's condition, noting any wear, damage, or restoration, ensuring Clients have a realistic understanding before purchase. e. For artworks with multiple variations or customization options, clearly outline the available choices, allowing Clients to make informed selections. f. Include accurate information about the provenance or history of the artwork, especially for vintage or collectible Items. g. Disclose any additional costs or fees, such as shipping, handling, or taxes, to prevent confusion or surprise charges during purchase. IV. Compliance with Policies and Regulationsa. Ensure compliance with all Mironova Art platform policies, including but not limited to the Creator’s Terms of Use or Dealer’s Terms of Use, Mironova Art Terms of Use, Personal Data Privacy Policy, Content Guidelines, Shipping Policy, and Dispute Resolution Procedure. b. Adhere to local, national, and international laws and regulations regarding the sale, shipment, and promotion of relevant products. V. Respectful and Non-Offensive Contenta. Avoid displaying content that promotes discrimination, glorification of violence and war, hate speech, dismemberment, explicit/adult material without any artistic purpose, and any illegal content deemed so under national and international legislation. b. Respect cultural sensitivities and diverse perspectives when creating and describing artworks or products. c. Ensure that representations or depictions of individuals, communities, or cultural symbols are respectful and avoid reinforcing stereotypes or prejudices. d. Refrain from using language, images, or symbols that may be considered derogatory, offensive, or disrespectful to any group or individual. e. When exploring sensitive or controversial topics through artwork, maintain a thoughtful and respectful approach, considering the potential impact on viewers. f. Avoid appropriating or misrepresenting elements from specific cultures or traditions without proper understanding or acknowledgment of their significance. g. Exercise caution when addressing political, religious, or social themes, ensuring that the content is presented in a manner that encourages thoughtful reflection rather than provoking unnecessary conflict or offense. h. Respect the privacy and dignity of individuals depicted in the artwork, obtaining necessary permissions or consents if the artwork involves recognizable individuals. VI. Intellectual Property Rightsa. Ensure that all uploaded content, including images, text, and multimedia, does not violate any third-party intellectual property rights. b. Seek necessary permissions or licenses for using copyrighted materials, logos, or trademarks in listings or promotional content. c. Refrain from using copyrighted or trademarked material without explicit permission or proper licensing, including logos, brand names, or recognizable artistic works. d. When referencing or featuring other artists' works or collaborations, ensure proper attribution or credit is given as per the original creators' requirements or agreements. e. Respect copyright laws and fair use principles when utilizing existing materials, and providing transformative or original contributions to the content. f. Verify the authenticity and legality of purchased or sourced materials used in the creation of artworks or products to avoid copyright infringement issues. g. If using public domain materials, verify the expiration of copyrights or applicable usage rights to ensure compliance with intellectual property regulations. h. Encourage respect for intellectual property rights among collaborators or contributors involved in the creation or development of artworks or products. i. In case of disputes or concerns regarding intellectual property rights, respond promptly and cooperatively to resolve the issues, respecting the rights of all involved parties. VII. Transparent Pricing and Informationa. Provide clear and transparent pricing for each listed Item, including any additional fees or charges. b. Disclose all relevant information about the Item, including its condition, flaws or imperfections, and restoration or repair history. c. Mention any special offers, discounts, or promotions associated with the Item, along with their terms and validity period, if applicable. d. Include information on the Item's provenance or history, if available, to offer Clients insights into its background or significance. e. Declare if the listed price is negotiable or if there is room for potential price adjustments, providing Clients with an understanding of the pricing flexibility. f. If the Item has any unique or rare attributes that may affect its value, such as limited edition status or historical significance, clearly highlight these features in the description. g. For artworks, specify if the piece is an original, a reproduction, or a print, providing clarity about the Item's authenticity and value. h. Clearly communicate any terms and conditions related to the pricing and payment methods accepted. VIII. Quality Assurance and Consistencya. Maintain consistent quality across listed Items, ensuring that the delivered Item matches the presented quality and description. b. Guarantee that artworks or products are free from defects or damages that are not explicitly mentioned in the listing. c. Conduct thorough quality checks before listing Items, ensuring they meet established standards and align with the provided descriptions. d. Document and disclose any imperfections, flaws, or irregularities in the Item's condition, providing accurate and detailed descriptions to manage Client expectations. e. Implement proper packaging procedures to ensure Items are adequately protected during transit, preventing damage or deterioration. Use appropriate packaging materials and methods based on the Item's nature and fragility to safeguard it during shipping. g. Insure valuable and delicate Items to protect against loss or damage during transit. h. Ensure transparency with Clients regarding any required insurance costs or additional fees associated with insuring high-value Items. i. Collaborate with reliable shipping partners or services known for handling delicate or valuable Items securely and responsibly. IX. Professional Communication and Staff Interactiona. Interact with all Platform users professionally and courteously, responding promptly to their inquiries, messages, and order-related communication. b. Provide reliable and helpful information to staff members and Clients, addressing any concerns, issues, or inquiries in a timely and respectful manner. X. Regular Inventory Updates and Availabilitya. Regularly update inventory by removing sold Items or Items no longer available for purchase. b.Ensure that listed Items are available in stock and ready for shipment to avoid delays or Client dissatisfaction. c. Monitor inventory levels consistently, maintaining adequate stock to meet potential Client demand without causing inventory shortages. d. Regularly review and adjust inventory listings to reflect accurate quantities, avoiding misleading availability status for Clients. XI. Collaboration and Partnership Integritya. When collaborating with other entities or artists, ensure transparency in partnerships, joint ventures, or collaborative projects. b. Clearly define roles, responsibilities, and agreements to maintain integrity and professionalism in collaborations. |
